Terms of Service
These Terms of Service (the "Terms") form a binding agreement between you and Artificial Intelligence AS, a Norwegian-registered company operating MedSeg ("MedSeg", "we", "us"). They govern your use of the MedSeg web application at app.medseg.ai (the "Service"). By creating an account or using the Service you accept these Terms and the Privacy Policy. If you do not, do not use the Service.
1. What MedSeg is
MedSeg is a web application for visualising and segmenting three-dimensional medical images. It includes pretrained AI models, custom model training, and an in-app assistant. The Service is provided free of charge for research, education, and personal non-commercial use, on the same basis as the bundled MedSeg Software License.
MedSeg is not a medical device. It has not been cleared, approved, certified, or registered by the U.S. Food and Drug Administration, the European Medicines Agency, the United Kingdom Medicines and Healthcare products Regulatory Agency, Health Canada, or any other regulator. It does not carry a CE mark. You must not use it for any clinical, diagnostic, prognostic, screening, or treatment decision concerning any patient. Outputs may be inaccurate, incomplete, or wrong. You are solely responsible for any decision made on the basis of what the Service shows you.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding agreement under the law of your jurisdiction. By creating an account you confirm both. The Service is not directed to children, and we do not knowingly create accounts for users under 18.
3. Permitted use
You may use the Service for the following purposes only:
- personal, academic, and non-commercial scientific research;
- teaching, coursework, and supervised learning at educational institutions;
- personal experimentation and skill development.
Use within a for-profit clinical practice, a paid clinical service, a commercial product, or any service offered to third parties for value is not permitted under the bundled license. A separate commercial product is available on request. Contact us if that is what you need.
4. Acceptable use
You shall not, and shall not attempt to:
- upload data containing direct patient identifiers, including un-anonymised DICOM headers, names, dates of birth, MRNs, or any data covered by HIPAA Protected Health Information rules, Article 4(1) of the GDPR, or equivalent local definitions. You are responsible for anonymising your data before uploading it;
- upload data you do not have the right to process under your institution's data-use agreement, applicable ethics approval, or the consent of the data subject;
- use the Service to make clinical decisions, or to provide a product or service that does so;
- reverse-engineer, decompile, scrape, copy, or redistribute the Service or its source code beyond what the bundled license allows;
- probe, attack, overload, or interfere with the Service, including automated traffic that bypasses the credit-quota system;
- share account credentials, or use a single account for more than one human user;
- use the Service to violate the law or anyone else's rights.
5. Your account
You are responsible for the security of your account credentials and for all activity that occurs under your account. Choose a unique password and do not share it. If you believe your account has been compromised, change your password from the Account page and email dlinradiology@gmail.com immediately.
You may delete your account at any time from the Account page. Login is disabled immediately. The account, together with all uploaded data, is permanently removed 30 days later. During those 30 days you may contact us to ask for the account to be restored.
We may suspend or terminate your account, with or without notice, if we reasonably believe that you have breached these Terms, that the account threatens the integrity of the Service, or that suspension is required by law.
6. Quotas and fair use
The Service is provided with a default per-user weekly compute quota and a default per-user storage quota. As of the effective date of these Terms the defaults are 50 model-inference credits per calendar week (training jobs cost 1 credit at queue plus 1 credit per 15 minutes of runtime) and 20 GB of storage. Use of the in-app assistant does not consume credits.
Current quota numbers are visible on your Account page and may change. To request a higher limit, email dlinradiology@gmail.com with a brief description of your project.
7. The in-app assistant
The Service includes a chat assistant powered by a large language model that we operate ourselves. The assistant is provided as a convenience to help you find your way around the Service. Its outputs may be incorrect, outdated, or inappropriate. Treat them as suggestions, not authoritative instructions, and never as medical advice. We do not use the content of your conversations to train models.
8. Your data and content
You retain all rights in the medical images, masks, models, and other content you upload or generate using the Service ("Your Content"). You grant us a limited, non-exclusive, worldwide, royalty-free licence to host, copy, transmit, render, and process Your Content for the sole purpose of operating the Service for you. We do not claim ownership of Your Content, do not sell or share it with advertisers or data brokers, and do not use it to train AI models.
You are responsible for the lawfulness of Your Content. You warrant that you have all rights, consents, ethics approvals, and lawful bases necessary to upload Your Content to the Service and to have it processed by us as described in the Privacy Policy.
9. Service availability
The Service is provided on an "as is" and "as available" basis. We do not guarantee uptime, accuracy of model outputs, fitness for any particular purpose, error-free operation, or any specific result. We may add, remove, or change features, including the bundled AI models, at any time. We will use reasonable efforts to give advance notice of changes that materially affect the Service.
10. Disclaimer of warranties
To the fullest extent permitted by applicable law, the Service is provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy of medical-image processing, non-infringement, and uninterrupted operation. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions our warranties are limited to the minimum allowed by law.
11. Limitation of liability
To the fullest extent permitted by applicable law, neither MedSeg, its authors, nor its contributors shall be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenues, goodwill, or business opportunities arising from or in connection with your use of the Service. Our total cumulative liability arising out of or in connection with these Terms shall not exceed one hundred euros (€100). Nothing in this section limits liability that cannot be excluded under mandatory law (for example, gross negligence or wilful misconduct).
12. Indemnification
You shall indemnify and hold harmless MedSeg and its authors against any third-party claim, loss, or expense (including reasonable legal fees) arising from your use of the Service in breach of these Terms, your breach of acceptable-use rules, your upload of content that infringes a third party's rights, or your use of the Service for any clinical decision.
13. Privacy
Our handling of personal data is described in the Privacy Policy, which forms part of these Terms. The Privacy Policy explains what we collect, why, how long we keep it, and your rights as a data subject.
14. Changes
We may amend these Terms from time to time. When a change is material, we will increase the version number at the top of this page and require you to re-accept the new version on next login. Other changes (typo fixes, cross-references) take effect when published. Your continued use of the Service after a change becomes effective is your acceptance of it. If you do not agree to a change, your remedy is to stop using the Service and delete your account.
15. Governing law and disputes
These Terms are governed by the laws of Norway, without regard to its conflict-of-laws rules. The courts of Oslo, Norway shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service, except that we may bring proceedings to enforce our rights in any jurisdiction where you are located. If you are a consumer based in the European Union, the United Kingdom, or another jurisdiction whose mandatory consumer-protection laws grant you rights that cannot be waived, those rights apply in addition to and prevail over this section to the extent required by that law.
16. Severability and entire agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full effect, and the invalid provision shall be replaced by an enforceable provision that comes closest to the original intent. These Terms, together with the Privacy Policy and the bundled MedSeg Software License referenced above, are the entire agreement between you and us concerning the Service and supersede any prior or contemporaneous communications on the subject.
